Tuscany Rent Direct does not check the truthful nature of the existence or contents of each property. Tuscany Rent Direct is not responsible for the precision of the adverts regarding houses and declines all responsibility for compliance of the information connected to the service with reality. The users of Tuscany Rent Direct services and those who place the announcements are solely responsible for the agreements entered into between the parties.

2) THE WEBSITE MAY ONLY BE USED FOR THE RENTAL OF HOUSES BETWEEN ADVERTISERS AND RENTERS

The entire contents of this website, including the information contained in every property announcement, are available exclusively for the purpose of organising direct rental agreements between advertisers and renters. This website is based on an exchange of information, and neither the advertisers nor renters may use any part of this website for commercial purposes. The collection and manipulation of the data contained in this website, as well as the keeping of the personal information, are strictly forbidden.

3) INTELLECTUAL PROPERTY

Tuscany Rent Direct and its entire contents are protected by copyright, by deposited trademarks, by the property rights and laws of the European Union and other nations in relation to such matters. The single elements that make up the website are also protected by copyright. In using this website, you agree to observe all the laws on copyright. Copying parts of the website and selling, distributing or publishing all or part of the contents in any way are strictly forbidden. Every breach of this paragraph shall subject the transgressor to the sanctions envisaged by law.

4) WITHDRAWAL RIGHT

Tuscany Rent Direct reserves the right to cancel a registration for any reason. For example: in the event of improper use of the website, action which jeopardises the security of the website, action which might damage other members and their property, or any other behaviour which may be detrimental to Tuscany Rent Direct.

5) USE OF PICTURES

All the photos used on the Tuscany Rent Direct website can be used for promotional or other purposes by Tuscany Rent Direct.

6) ADVERTISERS' CONDUCT

In using the website for the purpose of renting houses, advertisers shall not supply false or misleading information to Tuscany Rent Direct. Moreover, they shall not use this website in breach of the laws in force. Advertisers shall neither upload nor send files containing viruses, alterations, codes or any other software or program which could damage the operation of other computers, or with the aim of gaining unauthorised access to other computers. Advertisers shall neither publish nor send any content which could implicate Tuscany Rent Direct in civil or criminal legal proceedings.

7) EXONERATION AND LIMITATION OF RESPONSIBILITY

The use of Tuscany Rent Direct and all the information obtained from this website is at the user's risk. Tuscany Rent Direct does not offer any explicit or implicit guarantee in relation to the announcements on the website or the information contained in them, including the aspects of precision and truth.

8) TUSCANY RENT DIRECT'S RIGHT TO TERMINATE THE AGREEMENT

If the information supplied by an advertiser turns out to be false, or if the advertiser's announcement or actions are in breach of the law or damaging to the website or to that established in this agreement, Tuscany Rent Direct reserves the right to eliminate the advertiser's announcement at any time, at its own discretion, terminating the advertiser's access to the website without reimbursing any sums paid. Tuscany Rent Direct may also eliminate every announcement at its own discretion, in which case the advertiser shall be entitled to reimbursement of half the annual fee, as reimbursement of the registration fee paid.

9) THE ADVERTISERS' RIGHT TO TERMINATE THE AGREEMENT

Advertisers may eliminate their announcement or terminate their relationship with Tuscany Rent Direct at any time, by contacting the Customer Service department. No type of reimbursement is envisaged in these cases.

10) ENTITLEMENT TO TRANSFER RIGHTS

Tuscany Rent Direct may transfer its rights to this agreement without the consent of the advertisers. If Tuscany Rent Direct transfers its rights, or is sold to another entity, or enters into an agreement with another company to share the announcements, Tuscany Rent Direct, or its successor, shall inform the advertisers, who may decide to terminate their membership.

11) VAT

The 20% VAT is payable for all owners.

12) LEGAL ACTION AND APPLICATION OF THIS AGREEMENT

If a dispute should arise between the advertisers or users of the website and Tuscany Rent Direct, every legal action shall be brought before the Court of New York, in the State of New York, USA, which has complete jurisdiction, without allowance for any choice in the matter. If the legal action requests the application of this agreement, the successful party shall be entitled to reimbursement of the expenses reasonably sustained for legal aid.

13) THE COMPLETE AGREEMENT

These terms and conditions regarding the services form the complete agreement between the advertiser and Tuscany Rent Direct, unless otherwise established. The aforementioned agreement may not be amended, added to or changed and none of the elements established can be considered as waived, in full or in part, unless such waiver is recorded in a separate written agreement.
